Immigration Fee Schedule

GENERAL

Our Immigration Department is supervised by Agnieszka Tomasikiewicz an experienced solicitor, who joined the firm as the head of the Immigration Department in 2023. With over 11 years of experience, she is accredited under the Law Society’s Immigration and Asylum Law Accreditation, as a Senior Level 2 Caseworker and Supervisor. This allows her to provide specialist legal advice in a wide range of private and publicly funded immigration matters.

IMMIGRATION FEES

The following costs information is provided in accordance with the SRA Transparency Rules and the Price and Service Transparency guidance issued by the Law Society.

We always agree our costs with our clients in advance. The fee information provided here is a guide only and is not a binding quote for working on your case.

If you instruct us, we will provide you with a fee estimate tailored to your case. At Rustem Guardian Solicitors we are happy to discuss a range of funding options.

All the following fees detailed in our fee schedule will be subject to VAT at 20%.

The overall total cost will be subject to VAT at 20%.

FIXED FEE

The fixed fee we charge will be based on the circumstances in your case, such as:

• the amount of supporting evidence that we need to consider
• need for an interpreter
• whether you are applying with other dependants
• the level of support and assistance you require
• whether there are any complicating factors in your case (such as out of time Appeals/Applications, Need For Experts Etc).

The fixed fee is set at an hourly rate of £350.00 of a senior solicitor and £135.00 of a trainee solicitor or paralegal.

DISBURSEMENTS

Fee estimates do not include additional costs (disbursements) that may be incurred on the matter and are exclusive of VAT. Where applicable, fees will be subject to VAT at 20%.

Disbursements are costs related to your matter that are payable to third parties, such as court fees, application fees, Immigration Health Surcharge, counsel’s fees fees payable to interpreters/translators and experts, etc. We handle the payment of the disbursements on your behalf to ensure a smoother process.

The actual cost depends on the specific type of immigration matter.

For the Immigration Health Surchage, it rcurrently anges between £776.00 and £1,035.00 per year (subject to the changes annoucned by the Home Office).

HOURLY RATES

The rates do not include VAT. Time is recorded in units of 1/10th of an hour.

We also consider the complexity, urgency, and value of the matter.

Solicitors and legal executives with over 8 years’ experience £350.00
Solicitors and legal executives with over 4 years’ experience £250.00
Other legal executives and caseworkers of equivalent experience £200.00
Trainee solicitors, paralegals, and other fee earners £135.00

TIMESCALES

While the time required for preparing your case may vary,  depending on the complexity of each case, below is the typical timescales for some key stages:

Taking initial instructions – 2-3 hours;

Assessing and advising on the merit of the case – 4 hours;

Advising on the supporting evidence/documents – 4 hours;

Reviewing the documents and advising accordingly – 2-4 hours (may be longer if the case is complex)

Advising on the application process and drafting submissions – 1-4 hours

Assisting client with the drafting the application form 1-2 hours

Liaising and corresponding on client’s behalf – varies.

Advising on the likely timeframe and outcome of the application – 1 hour

Initial Fixed Fee Consultation £350.00 (price of consultation may be deducted from professional fees if we are instructed on the matter)

The key stages and work will involve the following, where you are making an immigration application.

Asylum Appeal – £3,500.00

Deportation – £2,000.00 – £4,000.00

Sponsorship Licence – £4,000.00

Entry Clearance – £2,500.00
